Interjurisdictional comparison tables

This document includes three tables that compare non-fatal strangulation offences across each Australian jurisdiction. Table 1 gives an overview of whether each jurisdiction includes particular elements in its offence (that is, a legislative definition, the without consent requirement and the domestic setting scope) and whether the offence can be finalised at Magistrates-level courts. Table 2 shows at a glance the differences in definitions between jurisdictions and Table 3 provides more detailed text of the legislation/common law in each jurisdiction.

Timeline of developments

This document shows the course of relevant reports, recommendations and legislative developments relating to non-fatal strangulation in Queensland.

Domestic setting definitions

The non-fatal strangulation offence is limited in a number of Australian jurisdictions to particular types of domestic relationships. This document includes Table 1 which compares the relationships covered in Queensland, South Australia, the Northern Territory and Victoria where the relationship is an element of the offence.  Table 2 compares the relationships covered in Western Australia and the Australian Capital Territory where the domestic setting/relationship is an aggravating circumstance only.

Maximum penalties table

The table in this document shows the maximum penalty for the non-fatal strangulation offence and, for comparison, a number of other relevant offences in Queensland.

On 8 April 2025 we released Research report 1.

With the help of the Red Rose Foundation, we asked victim-survivors of non-fatal strangulation about their experiences of the criminal justice process following strangulation and how the system could be improved. This report shares their views.
